Phil Arlotta Special Counsel

Phil holds an Honours degree in Social Sciences from Flinders University and a Law degree from The University of Adelaide. Whilst completing his Law degree, and following his admission to practice, Phil gained experience working at a number of small to medium legal practices between 1993 and 2003. Phil often appeared as Counsel in Family, Criminal and Civil matters and developed keen advocacy skills often appearing as Counsel in contested matters.

Phil’s initial practice focused on general commercial and property matters with an emphasis on leasing. In 1995 he joined a medium sized firm and during that time developed a practice in the areas of estates, commercial, criminal and family law.

Phil continued to develop his experience in the areas of commercial, property and estate matters, with an emphasis on conveyancing and drafting wills and other estate documents. In 2003, Phil established his own specialist legal practice (Arlotta & Associates) which operated for eight years and primarily focused on transactional law, namely, contract law, conveyancing and property law, sale of businesses and securities as well as estates and succession matters. In addition he handled a number of family law/matrimonial property settlements and commercial litigation matters.

In 2010 he was approached to join a large commercial law firm as Special Counsel, Estates and Succession. In this role, Phil acted in a number of estate administration matters including advising and acting in the administration of farming estates, drafting complex wills, wills involving testamentary trusts, enduring powers of attorney, appointments of guardians, and Deeds of Family Arrangement. He also provided extensive advice to executors as to their duties, liabilities and rights, as well as advising and acting in contested estates, disputes involving the use and abuse of powers of attorney and in matters before the Guardianship Board.

He joined Schirripa Evans Lawyers (formerly Schirripa Commercial Lawyers) in May 2012.

Phil has worked on the administration of significant estates including large farming interests, high value property transactions and one of the largest matrimonial property matters in South Australia. During his career he has also worked closely with accountants and financial planners. His practice has been predominantly working in small to medium practices acting for private clients, family business owners and private investors. He has donated his time to the SA Law Society Advisor Service and the Norwood Community Legal Service.

He is a member of the Law Society of South Australia.
